Per Diem Method — Assigns a daily dollar amount for pain and suffering (often based on daily earnings) and multiplies by the number of days from injury to maximum medical improvement. This method is particularly useful for longer recoveries.

Car accident settlements are typically calculated using either the multiplier method or the per diem method. The multiplier method takes your total medical expenses and multiplies them by a factor of 1.5 to 5 based on injury severity, then adds lost wages and property damage. Most car accident settlements take between 2 weeks and 2 years to resolve. Simple property-damage-only claims with clear liability may settle within weeks. Minor injury cases typically resolve in 3–6 months. Moderate injury cases can take 6–12 months. Cases involving serious injuries, disputed fault, or legal action can take 12–24 months or longer. It's generally advisable to wait until you've reached maximum medical improvement (MMI) before settling.
Key factors that increase settlement value include: severity and permanence of injuries, higher medical bills, longer recovery periods, documented lost wages and loss of earning capacity, clear liability on the other party, strong evidence (photos, witness statements, police reports), pre-existing conditions aggravated by the accident, and hiring an experienced personal injury attorney. Operating in a plaintiff-friendly jurisdiction also tends to result in higher settlements.
Generally, compensation for physical injuries and physical sickness is not taxable under IRS guidelines (Section 104(a)(2)). However, punitive damages are always taxable. Lost wage compensation may be subject to income tax. Emotional distress damages are taxable unless they stem directly from physical injuries. Interest on the settlement is also taxable.
