Understanding Workers' Compensation Settlements

Workers' compensation is a no-fault system meaning you can receive benefits regardless of who caused the workplace accident. However, you typically cannot sue your employer for additional damages. Settlements represent a lump sum payment in exchange for closing your workers' comp claim.

Types of Workers' Comp Benefits

  • Temporary Total Disability (TTD): Paid when you're completely unable to work during recovery. Typically 2/3 of your average weekly wage
  • Temporary Partial Disability (TPD): Paid when you can work in a reduced capacity during recovery
  • Permanent Partial Disability (PPD): Compensation for permanent impairment that doesn't fully prevent you from working
  • Permanent Total Disability (PTD): Benefits for injuries that permanently prevent any work. May include lifetime weekly payments

How Impairment Ratings Affect Settlements

Impairment ratings are assigned by physicians using the AMA Guides to the Evaluation of Permanent Impairment. A higher impairment rating directly increases settlement value. Ratings range from 0% (no impairment) to 100% (total body impairment). Even a 1-2% difference can mean thousands of dollars in additional compensation.
